HeadsUp Terms of Use (EULA)

Welcome to HeadsUp! By downloading, accessing, or using the HeadsUp mobile or desktop application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Medical Disclaimer (Important)

HeadsUp is a wellness tool, not a medical device.

No Medical Advice: The App is designed to help you build better posture habits. It does not diagnose, treat, cure, or prevent any disease or medical condition (such as scoliosis, kyphosis, or chronic spinal injury).

Consult a Professional: If you experience severe pain, numbness, or discomfort while using the App, stop using it immediately and consult a physician or physical therapist.

Accuracy: While we use advanced motion sensor data, the App's measurements are estimates and should not be used for clinical decisions.

2. Safety & Distraction

Stationary Use Only: HeadsUp is designed for use while sitting at a desk or standing in a safe, stationary environment.

Prohibited Use: Do NOT use the App while driving, operating heavy machinery, walking near traffic, or engaging in any activity where distraction could result in injury or death. We are not liable for accidents caused by distraction or the use of headphones in unsafe environments.

3. Subscriptions & Payments

Apple In-App Purchases: Some features (e.g., unlimited Mac use, historical stats) require a paid subscription or a one-time "Lifetime" purchase. All transactions are processed securely by Apple via your iTunes/App Store account.

Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID Account Settings.

Refunds: We do not handle refunds directly. All refund requests must be submitted to Apple Support and are subject to Apple’s refund policies.

4. License & Usage

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only.

You may not reverse engineer, decompile, or attempt to extract the source code of the App.

You may not use the App to develop a competing product.

5. Hardware Compatibility

The App requires specific hardware (e.g., AirPods Pro, AirPods Max, or AirPods 3rd Gen) to function. We do not guarantee compatibility with third-party headphones, older AirPods models, or Android devices. It is your responsibility to ensure you have compatible hardware before making a purchase.

6. Limitation of Liability

To the fullest extent permitted by law, HeadsUp and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Personal injury or physical pain.

Loss of data or device malfunction.

Damages resulting from the "Screen Blur" feature interfering with your work visibility.

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

7. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes indicates your acceptance of the new Terms.

8. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to its conflict of law principles.
