Terms of Service (Terms of Use) AI Voice Clone: Translator

Please read these Terms of Service (“Terms”) carefully before using the AI Voice Clone: Translator mobile application (the “App”), including the WhatLingo feature and any related services (collectively, the “Services”).

By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1. Acceptance of Terms These Terms constitute a legally binding agreement between you and TOON TECH LTD (“Company”, “we”, “us”, or “our”). We may update these Terms from time to time. Continued use of the Services after changes constitutes your acceptance of the revised Terms.

2. Eligibility You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Services. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. License to Use the Services We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use, subject to these Terms.

4. User Accounts Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

5. User Content and Voice Data

Your Content: You retain ownership of the voice recordings, voice clones, text, and other content you upload or create (“User Content”).

License to Us: By using the Services, you grant us a worldwide, royalty-free, non-exclusive, sublicensable license to use, host, reproduce, modify, translate, distribute, and process your User Content solely to provide, improve, and maintain the Services (including generating your voice clone and performing translations).

Voice Cloning: Your voice clone is generated for your personal use. You are responsible for how you use cloned voices. You agree not to use voice cloning to impersonate others, create deceptive content, or violate any laws.

6. Prohibited Conduct You agree not to:

Use the Services for any illegal, harmful, or fraudulent purpose.

Impersonate any person or entity or misrepresent your affiliation with any person or entity.

Upload or create content that infringes intellectual property rights, is defamatory, obscene, or violates privacy rights.

Attempt to reverse engineer, decompile, or extract the App’s source code or AI models.

Use the Services to create deepfakes or misleading audio intended to harm or deceive others.

Interfere with the Services or overload our systems.

Share your voice clone or translated voice notes in a manner that violates applicable laws.

7. Intellectual Property All rights, title, and interest in the App, its technology, AI models, design, and content (excluding your User Content) are owned by the Company or its licensors. You may not copy, modify, distribute, or create derivative works of the App without our prior written consent.

8. Third-Party Services and Integrations The App integrates with WhatsApp, Messenger, and third-party AI services. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties. When you use the WhatLingo share feature, the translated voice note is sent directly from your device to the chosen app at your instruction.

9. Accuracy and Disclaimers

Translation & Voice Quality: While we strive for high accuracy, AI translations and voice cloning may contain errors, inaccuracies, or unnatural speech. You should not rely on the Services for critical, legal, medical, or professional communications.

No Warranty: The Services are provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure operation.

10. Limitation of Liability To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

11. Termination We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. You may stop using the App at any time by uninstalling it.

12. Indemnification You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses arising from your use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution These Terms shall be governed by the laws of England and Wales without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in London, United Kingdom.

14. Changes to the Services or Terms We may modify, suspend, or discontinue any part of the Services at any time. We will notify you of material changes to these Terms.

15. Miscellaneous

These Terms constitute the entire agreement between you and us.

If any provision is held invalid, the remainder remains in effect.

Our failure to enforce any right does not waive that right.
